Terms & Conditions

These Terms & Conditions govern the use of the MySailCruise website and the booking of private catamaran charters, cruises, tours and experiences offered by MySailCruise.

1. Scope of These Terms

These Terms & Conditions apply to bookings and services provided by MySailCruise through its website, by email, telephone or through other authorised booking channels.

By requesting or confirming a booking, the customer acknowledges that they have read and accepted these Terms & Conditions, together with the specific terms communicated for the selected service.

2. Services Offered

MySailCruise offers private catamaran charter experiences and related services in destinations including the Mediterranean and Caribbean, subject to availability and the specific itinerary selected by the customer.

The exact characteristics of each service, including the catamaran, dates, itinerary, duration, number of guests, services included and price, will be specified in the relevant quotation, booking confirmation or contractual documentation.

3. Booking and Confirmation

A booking request submitted through the website, email or another communication channel does not automatically constitute a confirmed reservation.

A booking becomes confirmed only after MySailCruise has confirmed availability and the customer has completed the payment or other requirements specified in the booking documentation.

The booking confirmation and any specific service conditions provided to the customer form an integral part of the contractual relationship.

4. Prices and Payment

Prices are those indicated in the quotation or booking confirmation provided to the customer.

Unless otherwise specified, prices may vary depending on the selected catamaran, destination, travel dates, duration, number of guests and additional services requested.

The applicable payment schedule, deposit, balance and accepted payment methods will be communicated to the customer before the booking is confirmed.

Important: Any payment deadlines and cancellation charges applicable to a specific booking are those expressly stated in the relevant quotation or booking confirmation.

5. Services Included and Excluded

The services included in the price are those expressly listed in the quotation or booking confirmation.

Unless specifically stated otherwise, additional expenses or services not expressly included may be charged separately.

Customers should carefully review the inclusions and exclusions before confirming their booking.

6. Catamaran and Equipment

The catamaran shown on the website may be replaced by another vessel of equivalent or comparable characteristics where this is necessary due to operational, technical, safety or availability reasons.

The final vessel assigned to the booking will be communicated to the customer where applicable.

The use of the vessel and its equipment must always comply with the instructions of the skipper and applicable safety regulations.

7. Skipper and Safety

Where a professional skipper is included in the service, the skipper is responsible for navigation and the safe operation of the vessel within the limits of applicable law and the conditions of the voyage.

The skipper may modify the itinerary, route, departure time, anchorage or planned activities where reasonably necessary due to weather, sea conditions, navigation restrictions, technical circumstances or safety considerations.

Safety decisions made by the skipper must be respected by all guests.

8. Itinerary Changes

Sailing itineraries are subject to weather conditions, sea conditions, port or marina availability, local regulations, navigation restrictions and other circumstances beyond the reasonable control of MySailCruise.

For safety reasons, the itinerary may therefore be changed during the cruise.

Where an alternative itinerary is necessary, MySailCruise will make reasonable efforts to provide an experience consistent with the original booking.

9. Weather and Force Majeure

Sailing activities depend on weather and sea conditions.

MySailCruise may modify, postpone or interrupt a sailing activity where extraordinary or unavoidable circumstances, adverse weather, unsafe sea conditions, governmental restrictions, technical emergencies or other circumstances beyond its reasonable control make the planned service unsafe or impracticable.

The consequences of cancellation, postponement or modification will depend on the circumstances and on the specific contractual conditions applicable to the booking.

10. Cancellation by the Customer

Cancellation requests must be submitted to MySailCruise in writing, preferably by email.

Any applicable cancellation fees, refunds or other consequences depend on the specific booking conditions communicated to the customer at the time of confirmation.

Where mandatory consumer protection legislation applies, the customer's statutory rights remain unaffected.

11. Cancellation or Changes by MySailCruise

MySailCruise may be required to cancel, postpone or substantially modify a service due to circumstances affecting the safety or feasibility of the trip.

Where mandatory consumer protection legislation applies, customers will receive the rights and remedies provided by that legislation.

Where a booking is legally classified as a package travel arrangement, the applicable package travel rules and mandatory consumer protections will apply.

12. Passenger Information

Customers are responsible for providing accurate information required for the booking, including the correct names and relevant details of all participants.

Customers must promptly notify MySailCruise of any information that may be relevant to the safe provision of the service.

13. Travel Documents and Entry Requirements

Customers are responsible for ensuring that they hold all documents required for their journey, including valid passports, visas, authorisations and any other documents required by the countries or territories included in the itinerary.

Customers should verify entry, visa and health requirements with the competent authorities before travelling.

14. Guest Responsibilities

Guests must follow the instructions of the skipper and crew and behave in a safe and respectful manner throughout the experience.

Guests must not:

  • endanger themselves or other passengers;
  • interfere with the navigation or operation of the vessel;
  • use equipment contrary to instructions;
  • engage in unlawful or dangerous activities on board;
  • damage the vessel, equipment or property belonging to MySailCruise or third parties.

15. Damage to the Vessel or Equipment

Customers may be held responsible for damage caused intentionally or through negligent or improper use of the vessel, equipment or property provided during the service, subject to applicable law.

Any damage should be reported immediately to the skipper or MySailCruise.

16. Alcohol and Prohibited Activities

Alcohol consumption must always be responsible and must never interfere with the safety of passengers, crew or vessel.

Illegal substances, dangerous activities and any conduct that may endanger people or property are strictly prohibited.

The skipper may take appropriate safety measures where a guest's behaviour creates a risk to themselves, other passengers, crew or the vessel.

17. Children and Minors

Children and minors may participate in the experience only under the supervision and responsibility of their parent, legal guardian or accompanying responsible adult.

Parents or guardians are responsible for ensuring that minors comply with all safety instructions.

18. Accessibility and Special Requirements

Customers should inform MySailCruise of any accessibility requirements, mobility limitations, medical considerations or other special needs before confirming a booking.

The suitability of a specific vessel or itinerary may depend on its physical characteristics and operating conditions.

19. Personal Belongings

Guests are responsible for their personal belongings during the experience.

MySailCruise is not responsible for loss, theft or damage to personal items except where liability cannot legally be excluded.

20. Photography and Media

Photography or video recording may take place during some MySailCruise experiences.

Any use of identifiable images of guests for promotional or marketing purposes will be subject to the applicable consent and privacy requirements.

21. Liability

MySailCruise will perform its contractual obligations with reasonable care and in accordance with applicable law.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Where mandatory statutory consumer protections apply, those protections remain fully applicable.

22. Package Travel and Consumer Protection

Depending on the way in which services are combined and sold, a booking may constitute a package travel arrangement or another type of travel service under applicable legislation.

Where a booking qualifies as a package under applicable law, the mandatory rights, information requirements and protections applicable to package travel will apply.

Customers will receive the information required by applicable law before entering into the relevant contract.

23. Complaints

Customers are encouraged to report any issue concerning the service as soon as reasonably possible during the trip, so that MySailCruise and/or the skipper can have the opportunity to address the issue where possible.

Personal data collected in connection with bookings and use of the website is processed in accordance with the MySailCruise Privacy Policy .

25. Website Use

The content of the MySailCruise website is provided for general informational purposes.

Prices, availability, itineraries, vessels, services and other information may be changed or updated without prior notice.

The availability of a service is only confirmed when the booking has been formally confirmed by MySailCruise.

26. Intellectual Property

Unless otherwise indicated, the content of the MySailCruise website, including text, photographs, graphics, logos, videos and other materials, is protected by applicable intellectual property laws.

Content may not be copied, reproduced, distributed or commercially exploited without prior written authorisation, except where permitted by law.

27. Applicable Law

These Terms & Conditions are governed by applicable Italian law, without prejudice to any mandatory consumer protection provisions that may apply to the customer under applicable law.

28. Amendments to These Terms

MySailCruise may update these Terms & Conditions when necessary to reflect changes in services, legislation or business practices.

The version applicable to a booking is the version communicated or accepted at the time the relevant contract is concluded, subject to mandatory legal requirements.
